The paper argues for the possibility of aggravating the defendant’s civil liability in cases in which the victim´s human dignity has been infringed, through a disrespectful, degraded or humiliating conduct towards the victim. The Chilean legal system can incorporate this aggravating factor within the determination of non-pecuniary damages, performing an analogous function to aggravated damages in English law. Hence, the defendant’s liability is aggravated because of the way in which he or she treated his or her victim. This allows to aggravate the defendant’s liability without need to invoke the contested punitive damages. It als allows to mark a difference between malicious and merely negligent conduct within tort law.El presente trabajo defiende la posibilidad de agravar la responsabilidad civil extracontractual del demandado en aquellos casos en los que se ha vulnerado la dignidad de la víctima, mediante tratos vejatorios, degradantes o humillantes. De un modo análogo al funcionamiento de las indemnizaciones agravadas del derecho inglés, en el sistema chileno se puede incorporar este factor agravante en la determinación de la indemnización del daño moral. De esta manera, se agrava la responsabilidad por la forma en que el demandado trató a la víctima. Ello permite agravar la responsabilidad del demandado sin necesidad de acudir a los controvertidos daños punitivos, y permite establecer una diferencia entre las conductas dolosas de las meramente negligentes en la responsabilidad extracontractual.
