As prescribed by the the 1988 Federal Constitution, the right of habitation and of ecologically balancedenvironment are fundamental rights which in a first view they don´t enter in conflict, that happens becausethe wording of the constitutional norm is generic and without any limitation by providing a protected areathat has limits in the infra norms. The collision of fundamental rights raises up from this normative density,which will have its validity analized in an examination of constitutionality based on systematic analysis ofthe Constitution and the examination of proportionality. In this bond, the article aims to demonstrate thesolution form of the collision between the rights, based on defined steps that will explain the prevalence ofa right over another, in a proportional form, in order of the limitation to be the lowest possible.Conforme prescrito pela Constituição Federal de 1988, o direito à moradia e ao ambiente ecologicamenteequilibrado são direitos fundamentais que prima facie não entram em conflito, posto que a redação danorma constitucional é genérica e sem qualquer limitação, proporcionando uma área de proteção queencontra limites na norma infraconstitucional. A colisão dos direitos fundamentais suscita-se a partir desteadensamento normativo, que terá sua validade passada pelo crivo de um exame de constitucionalidadebaseado em análise sistemática da Constituição e o exame da proporcionalidade. Neste liame, objetiva oartigo demonstrar a forma de solução da colisão entre os direitos, baseados em definidas etapas quefundamentarão a prevalência de um direito sobre outro de forma proporcional, no intuito da limitaçãoimposta ser a menor possível.
