Resumen: En el presente trabajo se analizan diferentes perspectivas sobre el derecho a la educación en la actual coyuntura en América Latina,  desde tres dimensiones. En primer término la conformación histórica de los derechos asociados a las ideas de ciudadanía y de Estados-nación pensados en tanto "comunidades imaginadas"  en tiempos formalmente homogéneos.   En segundo  término, las diferentes concepciones en disputa en torno al derecho a la educación y las funciones asignadas al Estado y a los otros agentes educativos en cada una de esas concepciones. Por último, las viejas y nuevas políticas que buscan materializar el derecho a la educación en un escenario tensionado entre la democratización y la mercantilización del conocimiento. Palabras claves: Educación; Derechos; Estado; América Latina.   Abstract: In this  paper we analyze the different views on the right to education in the current situation in Latin America, , from three dimensions. In the first place the historical formation of the rights associated with the ideas of citizenship and nation-states designed as "imagined communities" in formally homogeneous times. Secondly, the different conceptions in dispute over the right to education and the functions assigned to the state and other educational agents in each of these conceptions. Finally, the old and new policies aimed at realizing the right to education in a scenario tensioned between democratization and commodification of knowledge.
