Starting from a brief historical analysis of the criminal policy applied in Brazil with regard to drug repression, the subjective description existing in the current Drug Law to differentiate the drug user from the drug dealer will be investigated, discussing the social problems caused by the aforementioned distinction, especially when verifying the mass incarceration experienced in the country after the publication of Law 11.343 / 2006. In this way, the present article will verify new political models of drug control, using the comparative method with some legislation already changed around the world, as well as identifying the progress in Brazil in relation to the debate over changes in the current anti-drug policy.Trabalho de Conclusão de Curso (Graduação)Partindo de uma breve análise histórica sobre a política criminal aplicada no Brasil no que diz respeito a repressão às drogas, será investigada a descrição subjetiva existente na atual Lei de Drogas para diferenciar o usuário do traficante, discutindo os problemas sociais ocasionados pela mencionada distinção, especialmente ao constatar o encarceramento em massa vivenciado no país após a promulgação da Lei 11.343/2006. Dessa forma, o presente artigo verificará novos modelos políticos de controle às drogas, a partir do método comparativo com algumas legislações já alteradas ao redor do mundo, bem como identificará o progresso no Brasil em relação ao debate por mudanças na política antidrogas vigente.
