The present thesis to discuss the civil liability by the parental alienation acts and the context of the respective duty to repair, verifying the implications of the legalpsychological consequences of parental alienation for the agents involved, making considerations about the respective configuration of civil responsibility not only under the strict perspective of Law but also of Psychology. For that, the deductive method was used, starting from the basic premise of the paradigm change of the family as an institution and getting at the specific premise of the interaction between the Tort Law and Family Law; and the dialogic method, through which an interdisciplinary and transdisciplinary dialogue was established, thus searching a study that involves basic and important knowledge from other areas of Law and also with an interface with Psychology. At the end, the types of damage involved in the practice of acts of parental alienation were understood, as well as the objective character of the civil liability of the alienator and the resulting duty, including not only the need to repair but also the resocialize.Pesquisa sem auxílio de agências de fomentoDissertação (Mestrado)A presente dissertação busca discorrer sobre a responsabilidade civil pela prática de atos da alienação parental e o contexto do respectivo dever de reparar, verificando as implicações das consequências jurídico-psicológicas da alienação parental aos agentes envolvidos, tecendo a respeito considerações sobre a respectiva configuração da responsabilidade civil não só sob a estrita perspectiva do Direito mas também da Psicologia. Para tanto, utilizou-se do método dedutivo, partindo-se da premissa básica da mudança paradigmática da família enquanto instituição e se chegando na premissa específica da interação entre o Direito das Obrigações e o Direito de Família; e do método dialógico, por meio do qual se estabeleceu um diálogo interdisciplinar e transdisciplinar, buscando-se assim um estudo que envolva conhecimentos básicos e importantes de outras áreas do Direito e também com interface da Psicologia. Ao fim, compreenderam-se os tipos de dano envolvidos quando da prática dos atos da alienação parental, bem como o caráter objetivo da responsabilidade civil do alienador e o decorrente dever daí advindo, compreendendose não só o mister de reparar como também o de se ressocializar.2023-08-30
