The legislation on education promulgated from the end of the decade of 1980, resultant one of the
process of re-democratization of Brazil, detaches the Infantile Education in the national scene. It
is legalized promotion of improvement in the attendance to the small child, moving away itself
from the assistencialist aspect that if constituted historic, in way that this starts to compose the
first stage of the Basic Education. Exactly that it does not have obligator character, this stage of
the education starts to have basic paper in the development of the potentialities of the children of
0 the 6 years and, to educate this public, the attentions if they come back toward the initial and
continued formation of the professionals who play the function of educators. In this same
legislation if finds the proposal of democratic management, whose definition still generates
controversy, but in a generalized manner is understood as the participation of all the pertaining to
school community in the taking of decision of the school. E more, offers of the Infantile
Education starts to be incumbency of the cities. Relating these legal proposals, we have in the
figure of the professor-manager of the Infantile Education of the municipal system of education a
professional whom she needs qualification to take care of to the new educational conceptions
stops with the small children: to work in team in the decision taking, especially in what it says
respect to the professional qualification, that must favor the development of the potentialities of
its public. It is from this premise that this work comes to question: the professor-managers who
act in the EMEI of Saint Maria have qualification? Where measure the City department of
Education of Saint Maria favors the qualification of the professor-managers of the Infantile
Education? These questionings had objectified this work to collate the proposals of the national
and municipal legislation on the initial and continued formation of the professors of the Infantile
Education with the real qualification of that they act in the EMEI. With this objective the inquiry
of quantitative boarding identified the situation of the initial and continued formation of the
professor-managers of the Infantile Education, as well as offers of formation continued for the
SMEd. The fulfilment of the legal requirements is confirmed on the minimum formation of these
professionals, the search of them for more qualification and the existence of offers of qualification in service on the part of the City department, exactly without financial resources
destined to this end. How much to the demanded minimum formation in law the existence of
great number of trainees is questionable acting in the EMEI without the foreseen qualification. In
what it says respect to the continued formation, questions it lack of financial resources and a
democratic management in fact (to participate) that it makes possible better conditions of
exploitation of the qualification in offered service.
