Elementos para uma compreensão tipológica dos processos estruturais

Abstract

Este estudo tem por objeto os elementos para uma compreensão tipológica dos processos estruturais. Inicialmente, contextualiza o tema por meio de uma análise crítica das características atribuídas em doutrina para a structural reform, para o public law litigation e para os problemas policêntricos. Com base em doutrina contemporânea, afirma a necessidade de aperfeiçoamentos na compreensão e caracterização dos processos estruturais. Sustenta que o fundamento distintivo decorre, no plano dos fatos, de uma mudança de racionalidade (de causal para teleológica) direcionada a uma transição não imediata entre estados de coisas. No plano normativo, identifica-se que referida transição se procede por meio de uma aplicação processual da teoria dos princípios, na qual o processo se orienta por um resultado normativo imediatamente finalístico, prospectivo e com pretensão de complementaridade. Tal estrutura normativa implica uma análise de aspectos finalísticos e instrumentais por meio de normas de segundo grau. Os elementos resultantes de cada um desses aspectos são os responsáveis pelo conteúdo e pelo resultado do processo estrutural. No plano dos direitos, se identificam as características dos direitos tutelados em um processo estrutural e o modo como tal ocorre, inclusive sugerindo técnicas para tanto. Das características verificadas no estudo dos fatos, das normas e dos direitos se propõe a identificação dos processos estruturais, inicialmente por meio de um raciocínio conceitual e, por fim, por meio de um raciocínio tipológico, o qual se revelará mais adequado à realidade que se propõe representar.

This study has as its object the elements for a typological understanding of structural litigation. Initially, it contextualizes the subject by means of a critical analysis of the characteristics attributed in doctrine for the structural reform, for the public law litigation and for the polycentric problems. Based on contemporary doctrine, affirms the need for improvements in the understanding and characterization of structural litigation. It maintains that the distinctive foundation results, in the plane of the facts, from a change of rationality (from causal to teleological), directed to a non-immediate transition between states of affairs. At the normative level, it is identified that said transition is proceeded through a procedural application of the theory of principles, where the process is oriented by a normative result that is immediately finalistic, prospective and with a pretension of complementarity. Such a normative structure implies an analysis of finalistic and instrumental aspects through norms second grade. The elements resulting from each of these aspects are responsible for the content and outcome of the structural litigation. In terms of rights, the characteristics of rights protected in a structural litigation are identified, as is the case, including the suggestion of techniques for doing so. From the characteristics found in the study of facts, norms and rights in the structural litigation, it is proposed to identify structural litigation, initially by means of a conceptual reasoning and, finally, by means of a typological reasoning, which will prove more adequate to the reality that it is proposed to identify.
