Con la invenci?n de la computadora y el internet a mediados del siglo xx, fue necesario enfrentar las dificultades que pod?an presentarse para la protecci?n de la propiedad intelectual en este nuevo escenario, que lejos de quedar resueltas se vuelven m?s complejas en la medida que los avances tecnol?gicos ofrecen nuevos retos. Surgen, as? mismo, nuevos bienes inmateriales, como lo es el software, el que jur?dicamente se ha asimilado a una obra literaria y en consecuencia se protege por las normas autorales que, no obstante, ha generado m?ltiples discusiones doctrinales, sosteni?ndose por cierto sector que este bien es susceptible de ser patentado en caso de que se re?nan los presupuestos para este tipo de reconocimiento. Otros, defienden la necesidad de una normativa especial que contemple las condiciones especiales de este bien y, ante todo, se vislumbra la necesidad de un organismo especial, dotado de los recursos t?cnicos necesarios, que se encargue del registro y verificaci?n de los requisitos para su protecci?n, dado que se trata de un bien intangible con unas caracter?sticas particulares que demanda un tratamiento especial.With the invention of the computer and the internet in the mid-20th century, it was necessary to face the difficulties that could arise for the protection of intellectual property in this new scenario, which, far from being resolved, become more complex as technological breakthroughs offer new challenges. Likewise, new intangible assets emerge, such as software, which has been legally assimilated to a literary work and consequently is protected by copyright laws that, however, has generated multiple doctrinal discussions, being supported by a certain sector that this asset is likely to be patented in case budgets for this type of validation are met.
