La presente investigaci?n tiene por objeto analizar la evoluci?n que ha tenido la regulaci?n del software desde finales de los a?os setenta, cuando se consider? como un nuevo bien que debe ser protegido por ser creaci?n del ingenio humano, para determinar si actualmente es posible en nuestro sistema jur?dico otorgar una patente a este tipo de creaciones, cuando existe disposici?n expresa en la Decisi?n 486 del 2000 que proh?be otorgar una patente a este tipo de bienes.The purpose of this research is to analyze the evolution that software regulation has had since the end of the seventies, when it was considered as a new asset that must be protected because it is the creation of human ingenuity, to determine if it is currently possible in our system Legally grant a patent to this type of creations, when there is an express provision in Decision 486 of 2000 that prohibits granting a patent on this type of property.
