En este texto se muestra cómo el reconocimiento jurisprudencial de la sociedad de hecho surgida entre concubinos, solo fue posible una vez el liberalismo asumió el poder en los años 30, debido al cambio ideológico en la estructura estatal que ello supuso y al nombramiento como magistrados de juristas antiformalistas y desligados del ideario católico-conservador, bajo el cual algún reconocimiento de efecto jurídico beneficioso entre los concubinos era imposible. Se encontró la relación entre la ideología política liberal y el reconocimiento de un efecto jurídico beneficioso del concubinato por parte de la Corte de Oro, protector del ánimo societario, sin importar las connotaciones religiosas que la referida figura generaba; a partir de un análisis descriptivo de la figura jurídica del concubinato, que incluyó la recopilación histórica jurisprudencial, normativa y doctrinaria y corroboró la relación antes expuesta. Del debate que en su momento suscitó el reconocimiento de la figura del concubinato, se recogen propuestas para analizar el dilema jurídico que se presenta con las parejas homoparentales, sus derechos y la ideología políticoreligiosa de los Magistrados de la Corte Constitucional, las cuales se sintetizan en que aquel no se resuelva ciñéndose solamente a dogmas religiosos.This text shows how the jurisprudential recognition of the de facto society that arose between concubines was only possible once liberalism assumed power in the 1930s, due to the ideological change in the state structure that this entailed and the appointment as magistrates of anti-formalist jurists and detached from the Catholic-conservative ideology, under which some recognition of beneficial legal effect between the concubines was impossible. The relationship between the liberal political ideology and the recognition of a beneficial legal effect of the concubinage by the Golden Court, protector of the corporate spirit, was found, regardless of the religious connotations that the referred figure generated; based on a descriptive analysis of the legal status of the common-law partner, which included the jurisprudential, normative and doctrinal historical compilation and corroborated the aforementioned relationship. From the debate that at the time raised the recognition of the figure of the concubine, proposals are collected to analyze the legal dilemma that arises with homoparental couples, their rights and the political-religious ideology of the Magistrates of the Constitutional Court, which are synthesized in that it is not resolved by sticking only to religious dogmas.
