El tráfico ilícito de personas es un importante negocio del crimen organizado, que afecta al mundo entero, incluyendo a Uruguay. La Oficina de las Naciones Unidas contra la Droga y el Delito ha llegado a identificar –a escala global– las treinta principales rutas de contrabando de migrantes, a través de las cuales se llegó a traficar a un mínimo de 2.5 millones de migrantes en 2016, generando entre U$S 5.5 y 7 billones. Esta situación internacional no le es ajena al Uruguay, donde el tráfico ilícito de personas constituye una realidad latente, a pesar de encontrarse bastante invisibilizada. El tráfico ilícito de migrantes ha llevado a una intensa actividad normativa en el ámbito universal, regional y nacional con la finalidad de combatirlo. El objetivo general del presente trabajo consiste en analizar esa misma legislación, a los efectos de determinar qué se entiende por tráfico ilícito de migrantes. En particular, este trabajo procura responder las siguientes interrogantes: a) ¿Cuál es el marco jurídico aplicable al tráfico ilícito de migrantes?; b) ¿Qué definiciones de tráfico ilícito de migrantes encontramos en el ordenamiento jurídico uruguayo e internacional? y, por último, c) ¿Qué elementos integran esas definiciones?The smuggling of migrants is an important source of business for organized crime, which affects the entire world, including Uruguay. The United Nations Office on Drugs and Crime has come to identify –on a global scale– the top thirty migrant smuggling routes, through which at least 2.5 million migrants were smuggled in 2016, totaling a revenue between US$5.5 and 7 billion. This international situation is not foreign to Uruguay, where the smuggling of migrants constitutes a latent reality, despite its significant invisibility. Migrant smuggling has led to intense legislative activity at universal, regional and national levels in order to combat it. The general objective of this paper is to analyze this very legislation, in order to determine what is meant by smuggling of migrants. In particular, this work seeks to answer the following questions: a) What is the legal framework applicable to the smuggling of migrants? b) What definitions of "smuggling of migrants" do we find in the Uruguayan and the international legal systems? and, finally, c) What elements make up these definitions?Facultad de Ciencias Jurídicas y Sociales
