It’s important to start by stating that when a custodial sentence is imposed, what is sought is to ensure that the sentenced person is prevented from subsequently executing criminal actions. Indeed, the concept of punishment evolves in terms of the meaning attributed to it. This is due to the social, political, and economic context in which the norms establish the means for the fulfillment of the functions in the prison systems, mainly in the protection of human rights. This underlines that the penalties and security measures imposed by the codes require further careful analysis in the scope of their assessment. Therefore, in this article it’s considered decisive to analyze the current state of the social reinsertion system in Mexico, enunciating the main aspects in the management of penitentiary centers that make it difficult to access the purpose of integrating people who have graduated from the justice system to their community, in stable conditions. By way of conclusion, it’s observed that one of the greatest mistakes lies in the omission of requiring trained personnel and working in interdisciplinarity in matters that involve the containment of crime, from the institutions arranged for such objects.Es importante iniciar declarando que cuando se impone una pena privativa de libertad, lo que se busca es alcanzar el que se prevenga que el sentenciado ejecute subsecuentemente acciones delictivas. En efecto, el concepto de la pena evoluciona en cuanto al significado que se le atribuye. Esto en razón del contexto social, político, económico en que las normas establezcan los medios para el cumplimiento de las funciones en los sistemas de reclusión, principalmente en la protección de los derechos humanos. Con ello se subraya que las penas y medidas de seguridad impuestas por los códigos, requieren seguir analizándose con minuciosidad en el alcance de su valoración.  Por lo anterior, en este artículo se considera determinante analizar el estado actual del sistema de reinserción social en México, enunciado los principales aspectos en la gestión de los centros penitenciarios que dificultan acceder al propósito de integrar a las personas egresadas del sistema de justicia a su comunidad, en condiciones estables. A modo de conclusión se observa que uno de los mayores desaciertos radica en la omisión de requerir a personal capacitado y trabajando en interdisciplinariedad en los asuntos que involucran la contención del delito, a partir de las instituciones dispuestas para tales objetos.
