Dicha Legislación Nacional e Internacional surge en respuesta de la Comunidad Marítima Internacional y Nacional, con la finalidad de definir como actos de Piratería o no, hechos, como el caso del buque de Bandera Italiana “ANCHILLE LAURO”, el mismo fue objeto de secuestro por un grupo terrorista, donde asesinaron a un ciudadano norteamericano; asimismo los sucesos ocurridos en los buques, “SANTA MARIA” de Bandera Portuguesa en el año 1.961, efectuado por 24 antifacistas gallegos y portugueses al mando de Enrique Galvao, que durante 13 días fuese secuestrado, donde gracias a la intervención del Gobierno del Presidente Kennedy de los Estados Unidos de Norteamérica se rescato el buque y se dio con los secuestradores, los cuales solicitaron asilo en Brasil; el buque “FALKE” de bandera Alemana en el año 1.929(al mando del derrocado Presidente Román Delgado Chalbaud, con el objeto de derrocar el Gobierno del General y Dictador venezolano Juan Vicente Gómez) ; el buque “CITY OF POROS” transbordador Griego que en fecha 11 de Julio de 1988 fueron asesinadas 9 personas, y 46 heridas de los 540 pasajeros a bordo, por un grupo de árabes liderado por Abú Nidal posteriormente capturado ese mismo año; el caso de actos de Piratería por la embarcación atunera mexicana “MACEL”; y finalmente el caso del “ANZOÁTEGUI” de bandera Venezolana en el año 1.963.Based on qualitative methodology and documentary International Law recognizes that it is in many ways applicable to our geography.
