La responsabilidad penal corporativa: un desarrollo vanguardista que urge implementar en Colombia

Abstract

Crime prevention is constituted today as an imperative duty of the entrepreneurs. This objective, which is becoming more and more relevant given the presence of corporations in the different transactional areas of goods and services among society, is approached currently only from strategies such as compliance. This text seeks to establish that the establishment of the corporate criminal liability in Colombia is a necessity. Under this model will be easier to avoid criminal scenarios in the enterprises, since one of the functions of the penalty, is the general prevention of crime. In addition, the criminal liability of the enterprises would strengthen the existing strategies such as compliance, stimulating its universal establishment at the corporate level. This stimulus is achieved by making possible the formulation of indictments noun against the corporations. In this scenario, having a compliance program stands as a defense strategy for the processed company
