Sobre el origen de la ciencia administrativa en España

Abstract

Bajo la premisa de que la investigación histórica permite aproximarse al sentido de la funcionalidad y analizar los problemas que rodean a las instituciones actuales, este artículo presenta las aportaciones de los tratadistas españoles en materia de derecho administrativo a lo largo del siglo XIX, particularmente en cuanto a la influencia francesa y el pensamiento liberal-ilustrado. Asimismo, plantea la preocupación práctica de dichos tratadistas por aplicar sus teorías a los intereses sociales y la necesidad de determinar cuál es el verdadero papel de la administración pública y la clara distinción entre ésta y el concepto de Gobierno. / Under the premise of which the historical investigation allows to come near to the sense of the functionality and to analyze the problems that surround to the present institutions, this article presents the contributions of the Spanish theoreticians in the matter of administrative law throughout century XIX, particularly as far as the French influence and the liberal-illustrate thought. Also, it raises the practical preoccupation of those theoreticians in matter of the appliance of their theories to the social interests and the necessity to determine which is the true paper of the public administration and the clear distinction between this one and the concept of Government.
