Resumen
La explicación de los precedentes vinculantes en el ordenamiento constitucional peruano importa una labor en la cual se avizoran distintos contextos: de un lado se ha ido afianzando como categoría normativa dentro del sistema de fuentes que comunica la jurisdicción constitucional peruana y de otro lado, ha distinguido una estructura de suma polémica entre los jueces del Poder Judicial, en tanto se ha avispado su carácter de coerción y restricción como categoría sui generis respecto de la interpretación jurídica en general. Pese a este pormenor, suele afirmarse persuasivamente, que las sentencias del Tribunal Constitucional son vinculantes; sin embargo, no siempre quedan claros los alcances y matices de esta expresión. La presente investigación científica cualitativa está estructurada en tres partes. La primera parte dedicada a la interpretación constitucional y el neoconstitucionalismo como un nuevo modelo institucional del derecho. La segunda parte está dedicada a la teoría argumentativa general del precedente vinculante y sus aspectos conceptuales básicos. Y finalmente, la tercera parte de la tesis se denomina: exploración al precedente constitucional vinculante a partir de la exégesis del Código Procesal constitucional y la interpretación del Tribunal Constitucional peruano: marco legal y jurisprudencial. En definitiva, la visión del TC se deduce de toda una doctrina muy presente en la literatura jurídica contemporánea denominada neoconstitucionalismo, que se refleja en la llamada constitucionalización del ordenamiento jurídico.
