RESUMEN
En la presente investigación que lleva como título “La rendición de cuentas a través del uso de boletas falsas en el delito de peculado”, versa la problemática referida a que, si el rendir cuentas con la presentación de bolsas que no son veraces, puede ser constitutiva de ser un acto propio del delito de Peculado. Para ello se plantea como hipótesis que no configura delito de peculado, toda vez que el Código Penal Peruano tipifica tal delito como aquella conducta en la cual el servidor se apropia indebidamente de caudales públicos que le fueron dados en administración, percepción o custodia, mientras que los viáticos suministrados no se encuadran en dichas posibilidades.
Para la misma, se tiene como objetivo general determinar si la rendición de cuentas a través del uso de boletas falsas para sustentar gastos no realizados constituye delito de peculado, contrastando la hipótesis con la dispersión teórica sobre el delito en análisis, así como se precisó la aplicación en el plano metodológico del método universal, así como el método general abarcando a los métodos deductivo e inductivo, y el método específico, generando con ello, una revisión desde múltiples aristas, sobre la problemática puesta a la palestra interpretativa.
Finalmente se concluye del desarrollo de la presente investigación que La rendición de cuentas a través de documentos falsos no constituye delito de peculado, sino de uso de documento falso.; del mismo modo se concluyó que la dogmática en su mayoría, así como del estudio de la jurisprudencia, se inclinan por no considerar estas conductas como propias del delito de peculado.
