Fundamentos jurídicos para regular el acceso a voto a partir de los 16 años en el Perú

Abstract

La presente investigación gira en torno a determinar los fundamentos jurídicos para regular el voto de menores de edad a partir de los 16 años en el Perú, objeto que funge como el eje de la argumentación desplegada en la presente investigación. Para ello, en primer lugar, se desarrolló el principio de ejercicio progresivo de los derechos por los adolescentes, haciendo énfasis en la importancia que este principio posee en contraste con los argumentos de la posición contraria a la defendida en este trabajo; asimismo, se resaltan las tendencias internacionales en relación con el ejercicio progresivo de los derechos por los adolescentes, por cuanto la discusión se desenvuelve en varios continentes a la vez. Seguidamente, se examinó el contenido de la dignidad humana y su relación con el derecho al sufragio, cuyo desarrollo encabeza uno de los objetivos principales de esta investigación. Igualmente, se analizó la legislación comparada en torno al tema propuesto, con la finalidad de implementar políticas de convicción para adolescentes mayores de dieciséis y menores de dieciocho años. Finalmente, la tesis, tentativamente, podría fungir como fuente para implementar futuras políticas sobre el acceso al voto de los menores de 16 años.

This research revolves around determining the legal grounds for regulating the voting of minors from the age of 16 in Peru, an object that serves as the axis of the argumentation deployed in this research. To this end, first, the principle of progressive exercise of rights by adolescents was developed, emphasizing the importance of this principle in contrast to the arguments of the position contrary to the one defended in this work; likewise, international trends in relation to the progressive exercise of rights by adolescents are highlighted, since the discussion is taking place in several continents at the same time. Next, the content of human dignity and its relationship with the right to vote was examined, the development of which heads one of the main objectives of this research. Likewise, comparative legislation on the proposed topic was analyzed, with the aim of implementing conviction policies for adolescents over sixteen and under eighteen years of age. Finally, the thesis, tentatively, could serve as a source for the implementation of future policies on access to voting for minors under 16 years of age.
