RESUMEN: Colombia se ha convertido en los últimos años en el principal país receptor de migrantes venezolanos, lo que ha conducido a un incremento significativo en el nacimiento de hijos de migrantes en su territorio. Este artículo estudia el caso específico de vulneraciones de derechos humanos de Yoel, para lo cual recopila el marco normativo y los estándares de protección vigentes respecto al derecho a la nacionalidad y al interés superior del niño, y analiza la manera en que operaron en el caso concreto. El artículo concluye que a pesar de que existía un marco normativo bastante garantista aplicable, el Estado colombiano incumplió con los estándares de protección nacionales e internacionales, dejando a un niño recién nacido en apatridia por 516 días.ABSTRACT: In the last years Colombia has become the main host country for Venezuelan migrants, significantly increasing the number of migrant child births within its territory. This article studies the specific case of Yoel’s human rights violation, for which it compiles the ruling legal framework and protection standards on the right to nationality and to the best interest of the child and analyses the way in which they worked in the case. The article concludes that, although there was a very protectionist legal framework applicable, Colombian State did not comply with national or international protection standards, leaving a newborn child in statelessness for 516 days.
