En el presente trabajo investigativo, su propósito central ha radicado en el estudio metodológico cualitativo desde un contexto internacional que le permite al lector tener el conocimiento acerca de la naturaleza jurídica del contrato outsourcing y su aplicabilidad en Honduras. Entre los principales temas objeto de este estudio se destacan la naturaleza jurídica, requisitos características, los beneficios económicos del contrato de outsourcing, así como sus ventajas y desventajas. Finalmente, se analiza la atipicidad legal de este contrato, tanto en Honduras como en el extranjero, y se plantea la necesidad de regular un marco legal para los contratos de carácter empresarial como lo es el outsourcing. Durante este proceso investigativo se plantearon los objetivos específicos que constituyen las pautas a seguir en este proceso exploratorio, como así lo son las variables de investigación y sus indicadores a efecto de obtener un resultado global de la investigación. Además, esta investigación se apoya un tanto, en sustento documental, como también en aportes significativos de expertos en el tema. Con esto, se nos permitió llegar a un análisis que concluye que: pese a que el outsourcing ha surgido como una estrategia de gestión para mejorar la competitividad en un entorno organizacional moderno, Honduras se mantiene renuente a su regulación, debiendo considerar la adopción de esta figura con el objeto de brindarles seguridad jurídica a las empresas, ya que el Outsourcing se ha constituido en una atractiva herramienta de gestión mejorar la competitividad y constituye un excelente recurso para la empresa moderna y Honduras debe, ya que en efecto, el outsourcing se está imponiendo en la mayoría de empresas como una forma eficaz de mejorar su eficiencia en un entorno cada vez más competitivo. Este fenómeno viene motivado por decisiones de tipo estratégico, financiero y tecnológico.This investigation work have main purpose in the methological cualitative studies from a International issue that permits the reader have the knowledge about the legal nature of the outsourcing contract and its applicability in Honduras. Among the main subject of this study are highlighted the legal nature, requirements, characteristics, the economics benefits of the outsourcing contract, its advantages and disadvantages. Finally, analyze the legal atypical of this contract, in Honduras as in the foreign countries, arises the need of regulate legal framework for the contract of business character as it is the outsourcing. During this investigation process the specific objectives were set that constitute the guidelines to follow in the exploratory process, it is with research variables and its indicators to obtain a global result of the investigation. Also, this investigation is supported, in documentary sustenance, as in giving experts meaning in the topic. By this, it allow to get an analyse that conclude: even though the outsourcing has arisen as a management strategy to improve competitiveness in a modern international environment, in Honduras its regulation have the will, consideration the figure adaptation with the purpose of giving legal security of the entrepreneur, due that the outsourcing has constitute an attractive work issue improve management and constitute an excellent resource for the modern entrepreneur and Honduras must do it, do to outsourcing is imposing in the major company as an effective way, to improve their major efficiency in competitive environment. This phenomenon is coming do to strategic decisions, budget and technological types.
