Cuando una persona natural desea constituirse como sociedad en Honduras, debe hacerlo mediante una plataforma digital en línea, sin embargo, se limita a la seguridad jurídica y la fe notarial. Partiendo de esta premisa, se decidió el presente proyecto de investigación, el cual abordó la seguridad jurídica, fe pública notarial y constitución de sociedades. Para tal propósito, el objetivo de esta investigación fue identificar la incidencia de la seguridad jurídica en la constitución de sociedades en línea ante la fe pública notarial en San Pedro Sula, departamento de Cortés. Estudio de investigación que se llevó a cabo bajo el enfoque cualitativo, mediante el método de recolección de datos y el derecho comparado de la normativa hondureña frente a las de Costa Rica y España, considerando como instrumento de investigación no probabilístico la entrevista a profundidad. La investigación permitió definir en qué consiste la seguridad jurídica, analizar el procedimiento para constituir una sociedad en línea y describir las ventajas y desventajas del proceso de la misma, sin la intervención de un notario público. Los resultados de la investigación y el análisis de datos indican que, el contrato societario tiene la misma validez ante las entidades públicas y privadas como si fuese el mismo instrumento público de constitución de sociedad otorgado por notario público. Y, bajo las leyes de Honduras no carecen de seguridad jurídica, más no se habla de la fe pública, dado que al constituirse en línea mediante la plataforma no existe intervención de notarios, como es el caso de Costa Rica y España, sin embargo, se concluyó que no incide en nada que una sociedad se constituya mediante contrato societario o por medio de un instrumento público de constitución de sociedad.When a natural person wants to establish as a society in Honduras, they must do it through an online digital platform, however, it is limited to legal security and notarial faith. Based on this premise, the present research project was decided, which addressed legal security, notarial public faith and societies constitution. For this purpose, the objective of this research was to identify the incidence of legal security in the constitution of online societies in front of the notarial public faith in San Pedro Sula, department of Cortés. The research study was carried out under the qualitative approach, using the data collection method and comparative law of Honduran regulations against those of Costa Rica and Spain, considering the in-depth interview as a non-probabilistic research instrument. The research made it possible to define what legal security is, analyze the procedure to establish an online company and describe the advantages and disadvantages of the process, without the intervention of a notary public. The results of the research and data analysis indicate that the corporate contract has the same validity for public and private entities as if it were the same public instrument of incorporation of a company granted by a notary public. And, under the laws of Honduras they do not lack legal security, but there is no mention of public faith, since when being established online through the platform there is no intervention of notaries, as is the case of Costa Rica and Spain, however, it was concluded that it does not affect anything that a company is constituted by a corporate contract or by a public instrument of incorporation of a company.
