In the Colombian legal system, pregnant women workers, instead of special protection in the employment relationship, can not be terminated unilaterally due to pregnancy during the time it lasted and maternity leave. The mandate of the constitution is based on the protection of the head. However, judges are interpreters of the law who are engaged in developing all the characteristics, conditions, conditions and elements that cover the figure through the jurisprudence they issue. The present investigation refers to the different degrees of protection that women have been granted in the state of gravity by the jurisprudential development and thetensions and disagreements that up to now have been presented in the Constitutional Court and the Supreme Court of Justice. to the figureEn el ordenamiento jurídico colombiano, la mujer trabajadora gestante goza de una especial protección consistente en que la relación laboral no puede ser terminada unilateralmente por el empleador por motivo del embarazo durante el tiempo que dure este y la licencia de maternidad. Como mandato constitucional se consagra la protección en cabeza del Estado para la trabajadora, de igual forma, el legislador en disposiciones del Código Sustantivo del Trabajo y otras leyes ha dotado de fundamento legal la figura del fuero de maternidad. Sin embargo, son los jueces como intérpretes de la ley los que se han ocupado de desarrollar todas las características, definiciones, condiciones y elementos que revisten la figura a través de las jurisprudencias que emiten.
