The present Research Project aims to analyze the institution of international adoption under the aegis of the new law on adoption - 12010/2009, which, among other actions, regulates international adoption and the new procedures for such an institute. Among the aspects studied stands out the basics of domestic adoption, international adoption and the requirements of both, so as to reach the final result, which is the identification of the major innovations introduced by the new law of adoption in international adoption. The method used was the deductive approach, taking as starting point the adoption of a general, coming to international adoption, and through adoption of the new law, we can perceive the emergence of the institution of adoption, its procedures and legislative changes responsible for solving social problems related to the subject. This work was made based on literature, since the argument is founded on doctrinal research. As international adoption is an exceptional measure, should be used only in latter case, which means, only if there is no alternative toinclusion of children and adolescents in a foster family nationwide. Based on this analysis it was concluded that the innovations coming from the new law appearedto give more effectively and guarantee to the institution of adoption.O presente trabalho de conclusão de curso tem por objetivo analisar o instituto da adoção internacional sob a égide da nova lei de adoção - 12010/2009, a qual, dentre outras providências, regula a adoção internacional e os novos procedimentos para tal instituto. Dentre os aspectos analisados, destacam-se os conceitos básicos de adoção nacional, adoção internacional, e os requisitos de ambas, para assim chegarmos ao resultado final, que é a identificação das principais inovações introduzidas pela nova lei de adoção, na adoção internacional. O método de abordagem utilizado foi o dedutivo, tendo como ponto inicial a adoção de um modo geral, chegando à adoção internacional, e através da nova lei de adoção, visualiza-se o surgimento do instituto da adoção internacional, seu procedimento e as modificações legislativas encarregadas de solucionar os problemas sociais referentes ao tema. Este trabalho foi realizado com base em pesquisa bibliográfica, visto que se fundou a argumentação em pesquisas doutrinárias. Como a adoção internacional é uma medida excepcional, deverá ser utilizado somente em ultimo caso, ou seja, somente se não tiver outra alternativa para inserção da criança ou adolescente em família substituta nacional. Com base nesta análise, concluiu-se que, as inovações advindas da nova lei, surgiram para dar mais efetividade e garantia ao instituto da adoção.
