O presente trabalho aborda o mito da neutralidade do juiz e a inteligência artificial, tendo como objetivo verificar a (im)possibilidade do mito da neutralidade do juiz ser superado pelo implemento da IA no lugar do magistrado humano, sendo necessário dissertar sobre evolução histórica e conceitos da IA, sua utilização contemporânea e futura, argumentos filosóficos acerca da objetividade da realidade e da linguagem, bem como a distinção entre neutralidade e imparcialidade, no que diz respeito ao julgamento de lides pelos magistrados. Pretende-se, assim, averiguar se o fato da IA ser programada por seres humanos e receber dados humanos, faz com que ela fique enviesada, possuindo, por óbvio, mais assertividade nas decisões prolatas, mas maculada pela falta de neutralidade de precedentes judiciais, ideais e valores do programador, capazes de perpetuar preconceitos e estigmas combatidos pela sociedade. Assim, se vislumbrará a aproximação entre Direito, Ciência da Computação e Filosofia, abordando a síntese entre inteligência artificial e o mito da neutralidade do juiz.The current project addresses the myth of judge’s neutrality and artificial intelligence, aiming to verify the (im)possibility to overcome the myth of judge’s neutrality with the implement of AI instead of the human judge, being necessary talk about historical evolution of AI, its use in contemporany times and future, philosophical arguments about objectivity of reality and language, as so de distinction between neutrality and impartiality, with regard about cause judgment by the judges. It is intended ascertain if the AI programmed by human beings and receiving human data, make it skewed, having, for sure, more accuracy making decisions, but damaged by the lack of neutrality and judicial precedents, ideas and values from the programmer, capable of perpetuate prejudgements and stigmas fought by the society. Covergence will be made by the law, computer science and philosophy, aprocching the syntesis between artificial intelligence and the myth of judge’s neutrality.
