O presente artigo, intitulado “Técnica Processual de Elaboração da Petição Inicial”, tem por objetivo realizar um estudo acerca da peça inaugural do procedimento comum, regido pelo Código de Processo Civil (CPC). Nesse sentido, buscar-se-á analisar os requisitos processuais da petição, constantes nos artigos 319 e 320 do CPC, bem como as causas de indeferimento da inicial, elencados pelo artigo 330 do CPC, e julgamento liminar de improcedência, abarcados pelo artigo 332 do CPC. A pesquisa se debruça na dogmática jurídica, fundamentada na legislação processual, na jurisprudência dos tribunais pátrios e se embasa no debate discursivo dos autores de direito processual civil.The present paper, entitled “Procedural Technique of Elaboration of the Initial Petition”, investigates the initial petition of the common procedure, governed by the Law Code of Civil Procedure (CPC). In this sense, an attempt will be made to analyze the procedural requirements of the petition, contained in articles 319 and 320 of the CPC, as well as the causes of rejection of the initial petition, listed by article 330 of the CPC, and preliminary injunction judgment, covered by the article 332 of the CPC. The research focuses on legal dogmatics, based on procedural legislation, on the jurisprudence of Brazilian courts and is based on the discursive debate of authors of civil procedural law.
