The Plenary of the Supreme Federal Court, during the trial of urgent measures at Argument of Non- Compliance of Fundametal Precept 347 – ADPF 347 in 2015, recognized the existance of a “State of Things Inconstitutional” due to the massive and persistent violation of fundamental rights, caused by structural flaws and bankrupcy of public policy in the national prison system. The trial lead to several actions, amongst them, the publishment of Resolution 213, of the National Council of Justice.The resolution proposes the mandatory presentation of all and any person arrested in flagrant in the presence of a judge within 24 hours and has the goal to adapt the national forensis practice to previsions of International Pacts of Human Rights which Brazil subscribes to. The present study, foremost, analyses the implantation of custody audiences at national level and the social impact of this measure in the number of preventive prisoners.O Plenário do Supremo Tribunal Federal, durante o julgamento de cautelar na Arguição de Descumprimento de Preceito Fundamental 347 – ADPF 347 em 2015, reconheceu a existência de um “Estado de Coisas Inconstitucional” em razão da violação massiva e persistente de direitos fundamentais, decorrente de falhas estruturais e falência de políticas públicas no sistema carcerário nacional. O julgamento desencadeou diversas ações, dentre elas, a publicação da Resolução 213, do Conselho Nacional de Justiça. A resolução dispõe sobre a obrigatoriedade de apresentação de toda e qualquer pessoa presa em flagrante à presença de um juiz dentro do prazo de 24 horas e tem como objetivo adequar a prática forense nacional às previsões dos Pactos Internacionais de Direitos Humanos dos quais o Brasil é signatário. O presente estudo, precipuamente, analisa a implantação das audiências de custódia a nível nacional e o impacto social dessa medida no número de presos preventivos.
