This work has for objective to analyze, from the perspective of the public interest, the issue of infiltrations between neighboring buildings under the Supervision of postures of Juiz de Fora. It was used the bibliographical research, analysis of specific legislation and jurisprudence, as well as of tax documents. By means of bibliographical research, sought to identify ways to provide more effectiveness to the actions aimed at solving the issue mentioned. Once recognized problems in relation to the effects of such fiscal actions, according to the theoretical framework adopted, admitting that the public interest involves weights depending on the specific case, it was proposed as a suggestion the adoption of two distinct procedures: one for the situations in which the presence of infiltrations offers neighborhood risks or a significant number of people, and another for those in which there is the characterization of the problembut absent the public interest. With this, it is believed that the performance of Fiscal will be focused on its main tasks provided for in municipal legislation, bringing thus contribution to the pursuit of the primary objective of public administration, the satisfaction of interests of the collectivity.O presente trabalho tem por objetivo analisar, sob a ótica do interesse público, a questão das infiltrações entre imóveis vizinhos no âmbito da Fiscalização de Posturas de Juiz de Fora. Para tanto, foi utilizada a pesquisa bibliográfica, análise da legislação específica e jurisprudência, bem como de documentos fiscais. Por meio da pesquisa bibliográfica, buscouse identificar meios para conferir mais efetividade às ações que visam à solução do assunto mencionado. Uma vez reconhecidos problemas em relação aos efeitos das referidas ações fiscais, de acordo com o marco teórico adotado, admitindo-se que o interesse público comporta ponderações conforme o caso concreto, propôs-se como sugestão a adoção de dois procedimentos distintos: um para as situações em que a presença de infiltrações oferece riscos à vizinhança ou a um número significativo de pessoas, e outro para aquelas em que há a caracterização do problema, mas ausente o interesse público. Com isso, acredita-se que a atuação do Fiscal de Posturas será focada em suas principais atribuições previstas na legislação municipal, trazendo, dessa forma, contribuição para a persecução do objetivo primordial da Administração Pública, a satisfação do interesse da coletividade.
