The present work aims to analyze the institutional violence faced by women, victims of violence concerning misogyny - due to the female gender, and who suffer a revictimization already in the seat of the Judiciary system. Thus, we will seek to understand in this work what are the reflexes that this secondary violence generates in society's view of Justice, especially on the part of the female population, neglected and violated precisely at the moment of asking for help from the institutional apparatus to achieve nothing more than the guarantee of their basic and fundamental rights, such as physical integrity, dignity and life. Regarding the research method, it has a bibliographic character, with a qualitative approach and hermeneutic method, which took place through bibliographic and documentary research. The theoretical framework was carried out through the use of the works of Taquette, Andrade and other dominant authors of the theme, duly mentioned throughout the work. In the end, it was verified that the existence of specialized and sensitized public agents is essential for the Justice to exercise its role as maintainer of the fundamental rights of these women, as well as that the Law, built as a portrait of the interests of the society which is bound, it cannot, in any way, admit that violence occurs within its institutional apparatus, mainly because, nowadays, it makes itself a representative of the Democratic State of Rights, which it must do through the evolution of its legislative instruments.O presente artigo tem como propósito analisar a violência institucional enfrentada pelas mulheres, vítimas de violências concernentes à misoginia - por motivo do gênero feminino, e que sofrem uma revitimização já em sede do sistema Judiciário. Destarte, buscaremos entender neste trabalho quais são os reflexos que esta violência secundária gera no olhar da sociedade acerca da Justiça, principalmente por parte da população feminina, negligenciada e violentada justamente no momento de pedir ajuda ao aparato institucional, para conseguir nada mais que a garantia de seus direitos básicos e fundamentais, como a integridade física, a dignidade e a vida. Em relação ao método de pesquisa, tem-se que está tem caráter bibliográfico, de abordagem qualitativa e método hermenêutico, a qual se deu através de pesquisas bibliográficas e documentais. O referencial teórico foi realizado por meio da utilização das obras de Taquette, Andrade e demais autores dominantes do tema, devidamente mencionados ao longo do trabalho. Verificou-se, ao fim, que a existência de agentes públicos especializados e sensibilizados é imprescindível para que a Justiça exerça seu papel como mantenedora dos direitos fundamentais dessas mulheres, bem como que o Direito, construído como um retrato dos interesses da sociedade a qual está vinculado, não pode, de maneira alguma, admitir que violências ocorram dentro de seu aparato institucional, mormente porque, hodiernamente, faz-se representante do Estado Democrático de Direitos, o que deve fazer mediante a evolução de seus instrumentos legislativos.
