With the advent of the Criminal Organization Act (12.850/2013), there has been a significant transformation in the way criminal proceedings are applied in Brazil, especially because of the strengthening of the plea agreement institute. Although the subject raises questions of various orders, the present work aims to thoroughly analyze the possibility and the limits for the rescission of the plea agreement. For this, besides the pertinent jurisprudential research, it is resorted to doctrinal sources and, mainly, a constitutional analysis on the subject, because, without the support of the Constitution, there is no legal analysis that is sustained.Com o advento da Lei de Organização Criminosa (12.850/2013), houve uma significativa transformação da maneira de se aplicar o processo penal no Brasil, especialmente em razão do fortalecimento do instituto da colaboração premiada. Embora o tema desperte questionamentos de ordens diversas, o presente trabalho tem como objetivo analisar minuciosamente a possibilidade e os limites para a rescisão do acordo de colaboração premiada. Para tanto, além da pesquisa jurisprudencial pertinente, recorre-se a fontes doutrinárias e, principalmente, uma análise constitucional sobre o tema, pois, sem o amparo da Constituição da República, não há análise jurídica que se sustente.
