| dc.description | Given the legislative omission about the legal guarantees of homosexual couples,
several questions and insecurities arise within the application of the law. In the
meantime, as a way of elucidation of some important issues, this monograph's main
objective is to demonstrate how the protection of the rights of homosexual couples
should be made, especially with regard to maternity leave. For this to be possible, an
analysis will be made of family entities, taking into account the modern family context
and the principles that guide these relationships. Likewise, the protection given by
the Constitution to the homoaffective family will be shown, as well as the legal
possibility of adoption by them. In addition, a historical and legislative analysis will be
made of the maternity leave institute, so as to understand its application in the labor
sphere and its importance. For this purpose, will be demonstrated the possibility of
extension of this institute to the adopters and, finally, homoaffective couples. | |

| dc.description | Diante da omissão legislativa acerca das garantias legais dos casais homoafetivos, surgem diversos questionamentos e inseguranças quando da aplicação do direito no caso em concreto. Nesse ínterim, como forma de buscar esclarecer alguns pontos, essa monografia tem como objetivo principal demonstrar como deve se dar a tutela dos direitos dos casais homoafetivos, sobretudo no que tange à licença maternidade. Para que isso seja possível, será feita uma análise acerca das entidades familiares, levando-se em consideração o contexto moderno de família e, ainda, os princípios que norteiam essas relações. Outrossim, será demonstrada a proteção dependida pela Constituição à família homoafetiva, bem como a possibilidade jurídica de adoção por parte deles. Além disso, será feita uma análise histórica e legislativa acerca do instituto da licença maternidade, de forma e entender sua aplicação no âmbito trabalhista e sua importância, tanto familiar quanto social. Devido a isso, busca-se demonstrar a possibilidade de extensão desse instituto aos adotantes e, por fim, aos casais homoafetivos. | |
