dc.descriptionThe present work aims to investigate the legal nature of the relationship between drivers and the company Uber. In this study, we seek to analyze whether there is a relationship of employment or self-employment in the light of labor legislation, as well as from the doctrine, judgments of the Superior Labor Court and scientific works related to the subject. Initially, a special focus is given to the phenomenon of uberization and the exploitation of work in the relationship established between Uber and its drivers. Then, we seek to contrast the survey carried out previously with the assumptions for the recognition of the employment relationship and self-employment. It is also explored the possibility of jurisprudential manipulation by Uber. Although the jurisprudence moves, until the present moment, towards the recognition of the driver as self-employed, in a recent decision the employment relationship was recognized, dealing mainly with the so-called algorithmic subordination. In this way, we seek to contribute to legal science in the development of the case study, raising legal and social aspects related to the thematic cut.

dc.descriptionO presente trabalho tem como objetivo investigar a natureza jurídica da relação entre os motoristas e a empresa Uber. Neste estudo, procura-se analisar se existe vínculo de emprego ou trabalho autônomo à luz da legislação trabalhista, bem como a partir da doutrina, julgados do Tribunal Superior do Trabalho e trabalhos científicos correlatos ao tema. Inicialmente, dá-se enfoque especial ao fenômeno da uberização e à exploração do trabalho na relação estabelecida entre a Uber e os motoristas. Em seguida, busca-se contrastar o levantamento realizado anteriormente com os pressupostos ao reconhecimento do vínculo empregatício e do trabalho autônomo. Explora-se, ainda, quanto à possibilidade de haver manipulação jurisprudencial por parte da Uber. Apesar de a jurisprudência caminhar, até o momento, no sentido do reconhecimento do motorista como autônomo, em recente decisão do Tribunal Superior do Trabalho foi reconhecido o vínculo empregatício, tratando-se principalmente da chamada subordinação algorítmica. Dessa forma, busca-se contribuir para com a ciência jurídica no desenvolvimento do estudo da situação jurídica, levantando-se aspectos sociais atinentes ao recorte temático.
