dc.descriptionThis monograph aims to analyze the right of non-human animals to life by observing the historical context of the legal protections created in favor of the subject, and, mainly, with the Complementary Law Project 27/2018. In addition, research based on important sources for such follow-up to the Law is used, such as the Federal Constitution, jurisprudence, the International Declaration of Animal Rights, the doctrine and research in books by national and international authors on the subject. Thus, in order to assist the search for understanding the subject, a reflective, systematic and critical procedure was used, based on bibliographic review and theoretical research. Thereby, by creating all the necessary background to understand the theme, it is possible to conclude how controversial the matter is, a fact that occurs due to the culture of the human animal in underestimating and lowering non-human animals in terms of their rights, as they only see them as an object and not as subjects of depersonified rights. Furthermore, the positive evolution of such a right in our law is identified, including with recent decisions that aggravate penalties regarding mistreatment, for example, in addition to an increasing number of researches carried out in the area.

dc.descriptionA presente monografia tem como objetivo analisar o Direito dos animais não humanos à vida ao observar o contexto histórico das proteções jurídicas criadas em prol do assunto, e, principalmente, com o Projeto de Lei Complementar 27/2018. Além do mais, utiliza-se como base a pesquisa em fontes importantes para tal seguimento do Direito, como a Constituição Federal, jurisprudência, a Declaração Internacional dos Direitos dos Animais, a doutrina e pesquisas em livros de autores nacionais e internacionais quanto ao tema. Dessa forma, com o propósito de auxiliar a busca por entendimento no assunto, é utilizado um procedimento reflexivo, sistemático e crítico, a partir de revisão bibliográfica e pesquisa teórica. Com isso, ao criar todo o embasamento necessário para compreender o tema, é possível concluir quão polêmico é a matéria, fato este que ocorre devido à cultura do animal humano em menosprezar e inferiorizar os animais não humanos quanto a seus direitos, pois os enxergam apenas como objeto e não como sujeitos de direitos despersonificados. Outrossim, identifica-se a evolução positiva de tal direito em nosso ordenamento, inclusive com decisões recentes que agravam penas quanto aos maus tratos, por exemplo, além de um crescente número de pesquisas realizadas na área.
