dc.descriptionThis work aims to carry out an analysis from a feminist perspective on the historical and social factors related to the practice of revenge pornography, discussing which are the main discriminatory aspects of society that contribute to women being the most affected victims. Furthermore, it is shown that the central purpose of the dissemination of intimate images carried out by a former partner is to achieve the moral and psychological integrity of the victim, such purpose is easily achieved, since society is still conservative and demands a posture from women predetermined modesty. It is also observed that, traditionally, women are assigned the burden of their own violence, and this also occurs in cases of revenge pornography, since at least to some degree, the victim is blamed for sharing the content. Based on this reality, the legislative treatment directed at women over time is addressed, within Brazilian criminal law and how it influenced the establishment of stereotypes, prejudices, discriminations and hierarchies. Finally, an analysis of the penal type of article 218-C, recently included in the Brazilian Penal Code, is carried out, discussing its limitations and its efficiency in repressing the crime of unauthorized pornographic exposure. Thus, it is concluded that the virtual media reproduce socially constructed sexist attitudes, and despite revenge pornography being a recent phenomenon, it constitutes one more way to subjugate women, and has primitive foundations. Thus, the criminal law alone is not enough to suppress the conduct, since the victim continues to suffer the effects before the patriarchal society, even after its criminalization.

dc.descriptionEste trabalho tem como objetivo realizar uma análise sob a perspectiva feminista acerca dos fatores históricos e sociais relacionados à prática da pornografia de vingança, discute-se quais os principais aspectos discriminatórios da sociedade que contribuem para que as mulheres sejam as vítimas mais afetadas. Ademais, demonstra-se que a finalidade central da divulgação de imagens íntimas realizada por um ex-companheiro é atingir a integridade moral e psíquica da vítima, tal propósito é facilmente atingido, visto que, a sociedade ainda é conservadora e exige da mulher uma postura predeterminada de recato. Observa-se ainda que, tradicionalmente, é atribuído às mulheres o fardo da própria violência sofrida, e isso também ocorre nos casos de pornografia de vingança, uma vez que pelo menos em algum grau, a vítima é culpabilizada pelo compartilhamento do conteúdo. A partir dessa realidade é abordado o tratamento legislativo direcionado às mulheres ao longo do tempo, dentro do direito penal brasileiro e como ele influenciou para que fossem estabelecidos estereótipos, preconceitos, discriminações e hierarquias. Por fim, é realizada uma análise do tipo penal do artigo 218-C, recentemente incluído no Código Penal Brasileiro, discute-se acerca das suas limitações e a sua eficiência para reprimir o crime de exposição pornográfica não consentida. Dessa forma, conclui-se que, os meios virtuais reproduzem atitudes machistas construídas socialmente, e apesar da pornografia de vingança ser um fenômeno recente, ela constitui mais uma forma de subjugar mulheres, e possui fundamentos primitivos. Sendo assim, o direito penal por si só, não é suficiente para suprimir a conduta, uma vez que, a vítima continua sofrendo os efeitos perante a sociedade patriarcal, mesmo após a sua criminalização.
