Fundamentos filosóficos de la prohibición jurídica del discurso de odio: una perspectiva psicopolítica

Abstract

El discurso de odio ha sido prohibido por múltiples instrumentos pertenecientes al Derecho Internacional de los Derechos Humanos. A pesar de esta regulación y de sus desarrollos en diferentes sistemas jurídicos nacionales, la prohibición jurídica del discurso de odio no es una cuestión pacífica en el seno de la doctrina jurídica y la discusión sobre su justificación moral aún subiste. Diferentes autores todavia se debaten en tomo a si hay razones suficientes para mantener esta prohibición. En esta tesis se expondrá que los argumentos formulados en este debate, tienen como característica una perspectiva no psicologista o no psicológica del ser humano, que no tiene en cuenta el punto de vista interno de las personas que intervienen en el proceso comunicativo del discurso de odio. Por esta razón, se propondrá que una perspectiva psicológica o psicologista del discurso de odio, está en capacidad de comprender con mayor profundidad que las tesis tradicionales, la manera como este discurso afecta la psique individual y colectiva. Además, a partir de este aparato analítico conceptual, se propondrá que el discurso de odio es una verdadera herramienta psicológica de poder que amenaza la democracia y que esto justifica su prohibición jurfdica.

Hate speech has been prohibited by multiple lnstruments belonging to lnternational Human Rights Law. Despite thls regulation and its developments in diff erent national legal systems, the legal prohlbition of hate speech is not a peaceful lssue within legal doctrine and the discussion about its moral justification still arose. Diff erent authors are still debating whether there are sufficient reasons to maintain this prohibition. In this thesis it will be exposed that the arguments formulated in this debate have as a characteristic a non-psychologist or non-psychological perspective of the human being. which does not take into account the interna! point of view of the people who intervene in the communicative process of hate speech. For this reason, it will be proposed that a psychological or psychologist perspective of hate speech is capable of understanding in greater depth than traditional theses, the way in which this speech aff ects the individual and collective psyche. In addition, from this conceptual analytical apparatus, it will be proposed that hate speech is a true psychological power tool that threatens democracy and that this justifies its legal prohibition.
