La legalidad presupuestal del postconflicto colombiano

Abstract

Para abril de 2018 se produjo la destitución del director del "Fondo Colombia en Paz" en medio de fuertes cuestionamientos sobre irregularidades en el manejo de recursos para el posconflicto. Dos años más tarde una investigación de la fundación libertad de prensa denunció la ejecución de recursos en publicidad y perfilamiento por parte del Gobierno con dineros del fondo del programa especial para la paz, asignado por la ley para la reincorporación a la vida civil de grupos en armas. Varias preguntas se destacan: ¿Cómo se ejecutan esos recursos?, ¿Cuál fue el papel del Congreso de la República en su destino final?, ¿puede el Gobierno disponer la forma en que los ejecuta? La investigación analiza la ejecución de recursos para financiar el posconflicto; determina si resulta acorde con el diseño constitucional del Estado colombiano desde el punto de vista presupuesta! y si el modelo de administración respeta uno de los principales objetivos de política pública del gobierno durante el período 2018-2022: "Paz con legalidad". By April 2018, the director of the "Colombia in Peace Fund" was dismissed amid strong questionings regarding the irregular management of post-conflict financia! resources. Two years later, an investigation by the Press Freedom Foundation denounced that the fond's financia! resources were spent in publicity and profiling, despite the law states that it had to be irivested on the reincorporation of armed goups into civil society. In this context, severa! questions remain: how are these resources executed?, what was the role of the Congress in defining its final destination?, can the Government decide how it executes them? This research analyzes the execution of resources to finance the post-conflict; determines whether it is consistent with the constitutional design of the Colombian State from a budgetary aproach and whether the administration model respects one of the main public policy objectives of the government during the period 2018-2022: "Peace with legality". The results demonstrate an omission of constitutional control; divergent criteria in relation to the categorization and nature of the funds and a contradiction with the Colombian economic constitutional regime that ended up favoring alleged acts of corruption.
