¿Es Necesario Ampliar el Marco Normativo en Materia Penal con Relación al Mercado de Valores?

Abstract

In the financial markets, large amounts of capital accumulate and this produces that both profits and losses can be very large. Under this circumstance, there are agents who, due to excessive ambition, to make money, want to alter the market for their own benefit. The consequences that market manipulation can have are very detrimental, one of them is the profitability of the rest of the investors, since these practices will make many agents lose money due to the malpractice of a few and for this reason, the State has to take care of it, to guarantee the free functioning of the market and therefore imposes sanctions for all those who act against this principle. In accordance with the above, a study is made with special attention to Colombia, if the current regulatory system is sufficient or if it needs to be expanded.
