O presente trabalho tem por escopo analisar a viabilidade de aplicação de métodos restaurativos no tratamento do crime de importunação sexual. Para tanto, considerou-se a construção social brasileira que, fincada em valores de natureza machista, historicamente subjuga a figura feminina, tratando-a como objeto da sexualidade masculina. Nesse sentido, considerando que o tratamento dispensado pela justiça tradicional à resolução de crimes de natureza sexual não tem se realizado a contento, torna-se imprescindível a busca por soluções alternativas que visem à responsabilização e, sobretudo a conscientização do ofensor, dada a atualidade do tema, bem como pela relevância prática, ante ao cometimento reiterado de condutas de violação à dignidade sexual de mulheres. The present work has the scope to analyze the changes that have occurred in the Military Penal law after come into of the Law 13.491/17, which changed ther art. 9 of the Military Penal Code the device responsible for outlining what is considered a crime in the military in time of peace. The legal changes promoted by the new Law are divided into two; a) eansion of the list of military crimes, that it is not limited to those provided in the MCP; b) jurisdiction in cases of crimes against civilians committed by armed forces military. Both topics will be addressed in this work, giving special attention to the possibility that the provided for in criminal law (which includes the extravagant) are considered military crimes. In this context it is necessary to discuss the apparent conflict between the Law 11.343/06 (drug law) and the art. 290 of the Military Penal Code (which provides the type of trafficking possession or use of narcotic or substance of similar effect) in the cases related to the use and trafficking of drugs in a place subjected to Militay administration given the topicality of the theme, as well as for its practical importance, compared with the significant amount of cases involving such conduct in the context of Military justice.
