O uso da arbitragem nos dissídios individuais trabalhistas: uma análise crítica da flexibilização do direito de acesso à justiça

Abstract

A presente pesquisa tem por objetivo analisar criticamente o uso do instituto da arbitragem nos dissídios individuais trabalhistas e a possibilidade de flexibilização do direito de acesso à justiça. Para tanto, é utilizado o art. 507-A da CLT, dispositivo inserido na legislação trabalhista pela Lei 13.467/2017. O estudo busca avaliar o impacto social decorrente da aplicação do referido dispositivo e a compatibilidade do mesmo com o princípio constitucional da inafastabilidade da apreciação judicial (corolário do direito de acesso à justiça), tutelado pelo art. 5º, XXXV, da CRFB/88.

This research aims to analyze critically the use of the Institute of arbitration in individual labor disputes and the possibility of the right of access to justice. To do so, you use the art. 507 of CLT, device inserted in the labor legislation by law 13.467/2017. The study seeks to assess the social impact arising from the application of this device and the compatibility with the constitutional principle of judicial review inafastability (a corollary of the right of access to justice), tutored by art. 5, XXXV, of the CRFB/88.
