Resumen
The right to health was enshrined in the Brazilian Constitutional Charter as a
fundamental right of the citizen. Over the years, given the inertia of the Public Power to
effect this right, individuals began to trigger the judiciary in order to achieve their right to
health in full. Then, the phenomenon of health judicialization arose, forming a solid
jurisprudence on the subject, attributing to the social right to health the prevalence when
in conflict with the budgetary limitations of federative entities. However, the exponential
growth of judicialization has caused significant impacts on budget execution, in a way
that the judiciary has modified its jurisprudence on the subject. According to the
constitutional principle of budget programming, it is seen that lawsuits cause real
embarrassment in public finances, even threatening the promotion of planned public
policies and provided for in the laws that regulate the budget. If once the fundamental
right to health and the budgetary constraints of the State were conflicted, the discussion
is currently deeper, because on the one hand the fundamental right to health of one, and
on the other the fundamental right to the health of the collectivity. Thus, the present work
proposes to analyze the jurisprudence of the Supreme Court on the effectiveness of the
right to health, especially the Extraordinary Appeal no 657.718/MG, from the perspective
of the constitutional principle of budget programming. It was concluded that the
jurisprudence of the Supreme Federal Court over the years, has been amended, in the
sense that in the face of the state's financial inability to provide any and all kinds of
therapeutic assistance, should favor the public policies developed and planned to
achieve the universality of the population, as opposed to the initial positioning that, as a
rule, required the State to comply with its constitutional obligation without worrying about
the financial consequences. O direito à saúde foi consagrado na Carta Constitucional brasileira como direito
fundamental do cidadão. Ao longo dos anos, diante da inércia do Poder Público em
efetivar tal direito, os indivíduos passaram a acionar o Poder Judiciário no intuito de
alcançar o seu direito em plenitude. Surgiu, então, o fenômeno da judicialização da
saúde, formando uma sólida jurisprudência sobre o tema, atribuindo ao direito social à
saúde a prevalência quando em conflito com as limitações orçamentárias dos entes
federativos. Entretanto, o crescimento exponencial da judicialização tem causado
impactos relevantes à execução orçamentária, de forma que o Poder Judiciário tem
modificado a sua jurisprudência acerca do tema. Diante do princípio constitucional da
programação orçamentária, vislumbra-se que as demandas judiciais causam verdadeiro
embaraço nas finanças públicas, ameaçando até mesmo a promoção de políticas
públicas planejadas. Se outrora tinha-se como conflito o direito fundamental à saúde e
as limitações orçamentárias do Estado, atualmente a discussão é mais profunda, pois,
tem-se de um lado o direito fundamental à saúde de um, e do outro o direito
fundamental à saúde da coletividade. Dessa maneira, o presente trabalho se propõe a
analisar a jurisprudência do Supremo Tribunal Federal em matéria de efetivação do
direito à saúde, em especial o Recurso Extraordinário no 657.718/MG, sob a ótica do
princípio constitucional da programação orçamentária. Concluiu-se que a jurisprudência
do Supremo Tribunal Federal ao longo dos anos, vem sendo alterada, no sentido de
que diante da incapacidade financeira do Estado em prestar todo e qualquer tipo de
assistência terapêutica, deve privilegiar as políticas públicas desenvolvidas e
planejadas para alcançar a universalidade da população, em contraposição com o
posicionamento inicial que, via de regra, obrigava o Estado a cumprir com sua
obrigação constitucional sem preocupar-se com as consequências financeiras.
