dc.description | This work brings together systemic connections in search of solutions to our problems, starting from a new possibility facing the conflict: the systemic (or phenomenological) posture. This is done in the three dimensions of the scientific work: practice, epistemology and theory. The practice is studied from the case of the attachment of the dumping ground in Natal/RN, in analogy with the flow of the methodology of systemic attendance, from an ecological perspective of the law, also dialoguing with the practice of systemic constellations. Epistemology is approached from the reformulation, associated to the conclusions of quantum physics, of the epistemological premises that support the transition to the scientific paradigm of systems thinking. Theory, still, is analyzed from the study of overcoming the mechanical theory of law and its economic implications from a new conceptual perspective of circular economy and generative ownership. We seek to demonstrate the pertinence of the systemic posture as a necessary existential alternative for humanity, for overcoming trash, violence and other evils that affect us. We draw a comparative synthesis between the mechanistic epistemological assumptions, those of systems thinking, the orders of love that govern the systemic constellations and the goals proposed by Capra and Mattei for the realization of the ecology of law revolution, and we conclude that the transition to systems thinking in the field of science, or systemic constellations, or in law, keep the same foundations, and this movement comes with the rescue of the archetypal fundamental value of the feminine, subjugated by the androcentric reason that guided mechanical thinking. We believe that this path will lead us to equilibrium. | |
dc.description | Este trabalho arremata conexões sistêmicas em busca de soluções para os nossos problemas, partindo de uma nova possibilidade diante do conflito: a postura sistêmica (ou fenomenológica). Isso é feito nas três dimensões do ofício científico: prática, epistemologia e teoria. A prática é estudada a partir do caso da penhora do lixão em Natal/RN, em analogia com o fluxo da metodologia de atendimento sistêmico, numa perspectiva ecológica do Direito, dialogando também com a prática das constelações sistêmicas; A epistemologia é estudada a partir da reformulação, associada às conclusões da física quântica, das premissas epistemológicas que sustentam a transição para o paradigma científico do pensamento sistêmico. A teoria, por sua vez, é analisada a partir do estudo da superação da teoria mecânica do Direito e suas implicações econômicas a partir de uma nova perspectiva conceitual de economia circular e propriedade generativa. Buscamos demonstrar a pertinência da postura sistêmica como uma necessária alternativa existencial para a humanidade, pela superação do lixo, da violência e de outros males que nos afetam. Traçamos uma síntese comparativa entre os pressupostos epistemológicos mecanicistas, os do pensamento sistêmico, as ordens do amor que regem as constelações sistêmicas e os objetivos propostos por Capra e Mattei para realização da revolução ecojurídica, e concluímos que a transição para o pensamento sistêmico no campo da ciência, ou das constelações sistêmicas, ou no Direito, guardam os mesmos fundamentos, e esse movimento se dá com o resgate do valor fundamental arquetípico do feminino, subjugado pela razão androcêntrica que orientou o pensamento mecânico. Acreditamos que este caminho nos conduzirá ao equilíbrio. | |
