Recurso Electr?nico Uno de los fundamentos de nuestra sociedad es la propiedad privada, ?qu? es? ?Cu?l es su fundamento? y ?c?mo se protege?... preguntas que se espera en el trascurso de esta monograf?a responder y brindar un marco de referencia en lo que respecta a la ley colombiana y su dinamismo con la jurisprudencia y el trascurrir de la sociedad.
La propiedad privada a trav?s del tiempo ha tenido algunos cambios con respecto a su manera de defender contra terceros, pero para el caso de los menores siempre aparece un espacio, espec?ficamente en la parte del manejo de propiedades adquiridas o heredadas, que en algunos casos no est? clara y en otros parece bastante arbitrario. Teniendo en cuenta el cambiante mundo jur?dico del siglo XXI en el que choca tradici?n, tecnolog?a y muchas veces el sentido com?n nos encontramos ante un sistema jur?dico anterior a la constituci?n del 91 con un c?digo del menor que espec?ficamente trataba todo lo concerniente al menor infractor y que regulaba muy poco la propiedad privada. A ese respecto como la mayor?a de vac?os en el sistema jur?dico colombiano se apoyaba en el c?digo civil, que a pesar de ser un documento muy completo, estaba ya para la ?poca fuera de tiempo y con una rigidez normativa que permit?a poco dinamismo al momento de actualizarse. One of the foundations of our society is private property, ?what is it? ?What is its reason to exist? And ?how to protect it? ... These are the questions that are expected to be responded in the course of this monograph and provide a reference with regard to Colombian Law, and its dynamism with the jurisprudence and the elapse of society.
Over the time, private ownership has had some changes in its own way to be protected against third parties, but in the case of minors there?s always been a gap, specifically in the management of the properties acquired or inherited by them, in some cases it?s unclear and in others it seems rather arbitrary.
Given the changing world in the XXI century, specifically the legal ways that collide with tradition, technology and even common sense; we are facing a previous legal system to the establishment of the Constitution of 1991, a "code of the child" was more oriented concerning the minor offender, leaving not much rom to regulate the private property. In regard to this issue, as well as most gaps in the Colombian legal system, it was supported with the Civil Code, which despite being a very comprehensive document it was old even for its time, with a regulatory rigidity that allowed little dynamism when updated.
