Control administrativo por parte del estado colombiano sobre la implementación de la biotecnología en materia de alimentos transgénicos en el departamento del Atlántico durante los años 2016 a 2023

Abstract

La presente investigación abordó el control administrativo por parte del Estado Colombiano sobre la implementación de la biotecnología en materia de alimentos transgénicos en el Departamento del Atlántico, seguidamente fue desarrollada en el tiempo comprendido entre 2016-2023. La cual tuvo como finalidad mostrar el vacío existente en la normatividad administrativa con respecto a la regulación de estos alimentos, al igual que el precario control administrativo que lleva el Estado Colombiano; lo anterior se analizó mediante la doctrina, jurisprudencia y la aplicación de instrumentos como entrevistas semiestructuradas y encuestas. Se destaca la importancia de que el Estado lleve mayor regulación y control, en aras de garantizar el derecho a la información de los consumidores como también los derechos a la salud y el cuidado del medio ambiente. Seguidamente, el desarrollo científico genético y biotecnológico no controlado en el ordenamiento jurídico vigente, pone en riesgo los derechos constitucionales a la salud, a la vida y al medio ambiente sano, porque rompe con el Principio de Precaución en los Alimentos Transgénicos. Finalmente, es motivo de interés y preocupación en lo que se refiere al bienestar y la salud de la población colombiana cuya muestra es objeto en este estudio. Se genera una controversia en lo atinente a los riesgos que generan para la salud, el medio ambiente, la vida, entre otros. Lo anterior se agudiza si se tiene en cuenta que la falta de etiquetado por desconocimiento de la norma o por publicidad engañosa, vulnera el libre consentimiento del consumidor de elegir el producto a consumir, por lo que se entra en el detrimento de sus derechos.

The present investigation addressed the administrative control by the Colombian State on the implementation of biotechnology in the field of transgenic foods in the Department of Atlántico, then it was developed in the time between 2016-2023. The purpose of which was to show the existing gap in the administrative regulations regarding the regulation of these foods, as well as the precarious administrative control that the Colombian State has; The above was analyzed through doctrine, jurisprudence and the application of instruments such as semi-structured interviews and surveys. The importance of the State having greater regulation and control is highlighted, in order to guarantee the right to information of consumers as well as the rights to health and care for the environment. Next, the genetic and biotechnological scientific development not controlled in the current legal system, puts at risk the constitutional rights to health, life and a healthy environment, because it breaks with the Precautionary Principle in Transgenic Foods. Finally, it is a matter of interest and concern regarding the well-being and health of the Colombian population whose sample is the subject of this study. A controversy is generated regarding the risks they generate for health, the environment, life, among others. The foregoing is exacerbated if one takes into account that the lack of labeling due to ignorance of the standard or misleading advertising violates the free consent of the consumer to choose the product to be consumed, therefore it is detrimental to their rights.
