El presente estudio de investigación titulado “El derecho a la identidad y la acción de impugnación de paternidad: análisis de la sentencia no. 1911-16-EP/21 de la Corte Constitucional del Ecuador”, tiene como finalidad, el análisis de los derechos fundamentales de las personas y el alcance del derecho a la identidad que recae sobre cada individuo y sobre los criterios que verifican la importancia en el desarrollo de los individuos; enunciar los elementos correctivos de la acción extraordinaria de protección encontrados en la sentencia no. 1911-16-EP/21. Este estudio se trata de un examen complexivo con un enfoque cualitativo, bibliográfico y documental con un nivel descriptivo que parte de la profundización teórica, doctrinaria y jurisprudencial. Las conclusiones y los resultados que hemos obtenido en este estudio de caso fue constatar la vulneración del derecho a la identidad del menor, junto a la vulneración del derecho a la igualdad y a la seguridad jurídica en la sentencia emitida el día 23 de febrero del año 2016.The present research study entitled, the right to identity and the paternity challenge action: analysis of sentence no. 1911-16-EP/21 of the Constitutional Court of Ecuador, has as its fundamental objective to make effective the fundamental rights of people; analyze the scope of the right to identity that falls on each individual and the inference about the criteria that verify the importance in the development of individuals; enunciate the corrective elements of the extraordinary protection action found in sentence no. 1911-16-EP/21. This study is a complex examination with a qualitative, bibliographic and documentary approach with a descriptive level that starts from the theoretical, doctrinal and jurisprudential deepening. The conclusions and results that we have obtained in this case study was the violation of the right to identity of the minor, together with the violation of the right to equality and legal certainty of the sentence issued on February 23, 2016.
