La responsabilidad médica profesional ante el empoderamiento del paciente es un concepto novedoso, recientemente incorporado por la Organización Mundial de la Salud (OMS), este criterio fue emitido con el objetivo de dar a conocer el alcance de las decisiones que pudieran llegar a tener los usuarios de la salud hoy en día para decidir una vez recibido el diagnóstico del médico como profesional el tratamiento a seguir. A nivel de la doctrina se han abierto un sin número de debates y preguntas en cuanto al ámbito de la responsabilidad civil que puede llegar a tener el médico como profesional de la salud frente al procedimiento que lleva a cabo ante el paciente. Por lo expuesto hasta el momento pareciera que existe cierta sinergia entre la relación médico-paciente, pero es justamente en este sentido en el cual está enfocado esta investigación, ¿Qué sucede cuando el criterio profesional del médico es rechazado de plano por el paciente y el mismo decide no continuar con el tratamiento poniendo en riesgo su vida?
