El presente trabajo tiene como finalidad evidenciar la postura de los medios de comunicación ante el cometimiento de un delito, tiene influencia en las decisiones judiciales y de qué forma se vulneran los derechos de los impartidores de justicia, por la incorrecta presión mediática que están sometidos debido al mal proceder de las noticias de los comunicadores, siendo así que influye el linchamiento mediático al que se someten los servidores judiciales. Hemos visto de cerca a través de los años el avance tecnológico de los medios comunicación, así como de su influencia en todas las jerarquías sociales, por lo que no son ajenas las palabras de Louis de Bonald, político, filósofo, escritor y publicista francés, quien manifestó “Un Estado puede ser agitado y conmovido por lo que la prensa diga, pero ese mismo Estado puede morir por lo que la prensa calle. Para el primer mal hay un remedio en las Leyes; para el segundo, ninguno. Escoged, pues, entre la Libertad y la Muerte…”. Siendo así, compartiendo la postura de este filósofo francés, sentí la necesidad de buscar una solución ante este inconveniente presentado y que como lo tengo en claro, reside en la influencia que los medios ejercen en las decisiones que emite el poder judicial. Con este documento aporto un breve, pero decidido análisis críticojurídico que nos permita reflexionar sobre esta realidad social y la protección de derechos en el Ecuador.The purpose of this work is to demonstrate the position of the media before the commission of a crime, if it has influence on judicial decisions and in what way the rights of justice providers are violated, due to the incorrect media pressure that they are subjected to. due to the misbehavior of the news from the communicators, while the media lynching to which the judicial servers submit influences. We have seen closely over the years the technological advancement of the media, as well as its influence on all social hierarchies, which is why the words of Louis de Bonald, a French politician, philosopher, writer and publicist, are not alien. who stated “A State can be agitated and moved by what the press says, but that same State can die because of what the press is silent about. For the first evil there is a remedy in the Laws; for the second, none. Choose, then, between Freedom and Death…”. Thus, sharing the position of this French philosopher, I felt the need to find a solution to this inconvenience presented and which, as I am clear, resides in the influence that the media exerts on the decisions issued by the judiciary. With this document I provide a brief but determined critical-legal analysis that allows us to reflect on this social reality and the protection of rights in Ecuador.
