En la presente investigación se desarrollará el delito de violación inversa, es decir cuando una mujer bajo amenazas, intimidación o utilizando cualquier mecanismo que pueda viciar el libre consentimiento del hombre, lo obligue a mantener una relación sexual. Se analizará básicamente la posibilidad de que una mujer pueda ser considerada como sujeto activo del delito de violación, ya que en el Código Orgánico Integral Penal en su artículo 171, menciona la palabra “acceso carnal”, lo cual hace referencia a que únicamente el hombre puede ser considerado como el agresor en este tipo de delito, existiendo un vacío legal. A su vez se demostrará que el artículo, anterior mente citada, transgrede principios constitucionales como el de igualdad y no discriminación. Por lo tanto establecerá un tipo de propuesta para que se reforme de manera urgente el Código Orgánico Integral Penal, para que mediante esta reforma se extienda la protección del bien jurídico de libertad sexual, en base al delito de violación, tanto a hombres como a mujeres.In the present investigation, the crime of reverse rape will be developed, that is, when a woman under threats, intimidation or using any mechanism that could vitiate the free consent of the man, forces him to have a sexual relationship. Basically, the possibility that a woman can be considered as an active subject of the crime of rape will be analyzed, since in the Organic Integral Penal Code in its article 171, it mentions the word "carnal access", which refers to the fact that only the man can be considered as the aggressor in this type of crime, there being a legal vacuum. At the same time, it will be demonstrated that the aforementioned article violates constitutional principles such as equality and nondiscrimination. Therefore, it will establish a type of proposal to urgently reform the Comprehensive Organic Criminal Code, so that through this reform the protection of the legal right of sexual freedom is extended, based on the crime of rape, to both men and women.
