La declaración de Interdicción por discapacidad como nueva función notarial.

Resumen
La petición de la interdicción para las personas con discapacidad mental es llevada a cabo
ante un juez en sede judicial, en juicio sumario, con una audiencia única, para declarar una
interdicción provisional, y dar nombramiento a un curador interino, que va a realizar la
representación en juicio, luego la evacuación de pruebas y la realización de una audiencia
única, única para la declaración de la interdicción definitiva y el nombramiento del curador,
trámite que dura aproximadamente ocho meses.
En tal sentido se propone el uso de una opción más expedita como lo es la jurisdicción
voluntaria, la cual es iniciada por la voluntad de las partes. Por lo que el notario, quien
cumple distintas funciones, entre ellas la de dar fe pública a los actos, es el indicado para
autorizar los tramites de jurisdicción voluntaria sin que se pierda la seguridad jurídica. El
objetivo de esta investigación es Analizar la declaración de Interdicción por discapacidad
como nueva función notarial. Como metodología, se trata de una investigación cualitativadescriptiva, llevando a cabo un análisis documental, para por medio de la aplicación de un
instrumento, se realizaran entrevistas. Como resultados se señala el garantismo en el
ordenamiento jurídico ecuatoriano con respecto a las personas con discapacidad, pero que en
la aplicación del derecho, amerita que se tomen en cuenta formas alternativas como la
jurisdicción voluntaria, para hacer más expedita la declaración de la interdicción. The request for interdiction for people with mental disabilities is carried out before a
judge in court, in a summary trial, with a single hearing, to declare a provisional interdiction,
and appoint an interim curator, who will carry out the representation in court, then the
evacuation of evidence and the holding of a single hearing, unique for the declaration of the
definitive interdiction and the appointment of the curator, a process that lasts approximately
eight months.
In this sense, the use of a more expeditious option is proposed, such as the voluntary
jurisdiction, which is initiated by the will of the parties. Therefore, the notary, who performs
different functions, including giving public faith to the acts, is the one indicated to authorize
the procedures of voluntary jurisdiction without losing legal certainty. The objective of this
research is to analyze the declaration of Interdiction due to disability as a new notarial
function. As a methodology, it is a qualitative-descriptive research, carrying out a
documentary analysis, through the application of an instrument, interviews are carried out. As
results, the guarantee in the Ecuadorian legal system with respect to people with disabilities is
pointed out, but in the application of the law, it is necessary to take into account alternative
forms such as voluntary jurisdiction, to make the declaration of the interdiction more
expeditious.
