El presente trabajo tiene la finalidad de analizar jurídicamente la constitución del patrimonio familiar y la importancia de que esta institución se efectúe en sede notarial. Para la metodología se aplicó el método teórico de análisis-síntesis y el método descriptivo. Con los resultados del estudio se espera evidenciar la necesidad de que este trámite se realice en sede notarial, sin dejar de lado los principios básicos del procedimiento notarial como pautas que rigen las acciones notariales bajo los principios de celeridad, eficiencia y economía procesal. De igual manera se busca disminuir la carga procesal en los juzgados, así como dar respuestas oportunas a los requerimientos de las/los ciudadanos para proteger sus bienes bajo esta figura jurídica.The present work has the purpose of legally analyzing the constitution of the family patrimony and the importance of this institution being carried out in a notarial office. For the methodology, the theoretical method of analysis-synthesis and the descriptive method were applied. With the results of the study, it is expected to demonstrate the need for this procedure to be carried out in a notarial office, without neglecting the basic principles of the notarial procedure as guidelines that govern notarial actions under the principles of speed, efficiency and procedural economy. In the same way, it seeks to reduce the procedural burden in the courts, as well as provide timely responses to the requirements of the citizens to protect their assets under this legal figure.
