El principio del interés superior del menor se encuentra en el Código Orgánico de la Niñez y Adolescencia (2003) en su artículo 11, mencionando distintos parámetros en cuanto a la aplicación, la competencia, la jurisdicción y su alcance. Este principio es de vital importancia en las relaciones parento-filiales, pues consagra que los niños y adolescentes son el sujeto titular de derechos activos, y gozan de privilegios que las normas, la sociedad, y el estado deben y tienen la obligación de garantizar para su efectivo goce. En el devenir se ha demostrado que las relaciones parento filiales no cumplen por diversos factores las obligaciones que hagan efectivos sus derechos, situación que impacta de forma negativa su desarrollo integral consagrado en el Art 44 de la Constitución de la República del Ecuador, es así, que el presente trabajo de titulación pretende analizar los distintos factores que afectan el cumplimiento del derecho de alimentos de los niños y adolescentes que es sustancial para su vida digna.Minors’ superior interest principle is found in the Childhood and Adolescence Organic Code (2003) in its 11th article, mentioning different parameters regarding function, competence, jurisdiction and its reach. This principle is of outmost importance regarding parent-child relationships, as it enshrines that children and adolescents are the main holders of active rights, and enjoy privileges that the norms, society, and the state must and have the obligation to guarantee for their effective enjoyment. It has been demonstrated that parent-child relations do not fulfil due to many factors, the obligations that give effect to their rights, a situation that negatively impacts their integral development enshrined in Article 44 of the Constitution of the Republic of Ecuador, thus, the present titling work aims to analyze the different factors that affect the compliance of children and adolescents with the right to food that is essential for their dignified life.
