Resumen
A lo largo de la exposición del presente trabajo de titulación se mostrará un análisis de
las normas que disponen la remoción del notario como servidor de la función judicial
si es que este tiene un auto de llamamiento a un juicio por haber sido involucrado en
delitos que están tipificados en el Código Orgánico Integral Penal y son sancionados
con prisión o reclusión en conformidad con el artículo 77 numeral 3 y en concordancia
con el artículo 122 numeral 1 del Código Orgánico de la Función Judicial.
En la primera parte de la investigación se presentará la naturaleza jurídica de la
remoción y el procedimiento que sigue el Consejo de la Judicatura para remover a un
notario que ha sido llamado a juicio penal. La segunda parte en cambio se centra en
analizar una Acción de Protección que se presentó en contra del Director General del
Consejo de la Judicatura por haber llevado a cabo la remoción de una notaria en el año
2020 vulnerando su derecho a la presunción de inocencia.
El objeto principal de este análisis es demostrar que existe una antinomia entre la
norma que regula la remoción que es de carácter infra constitucional y la norma que
establece el derecho a la presunción de inocencia como garantía básica del debido
proceso que se encuentra en el artículo 76 numeral 2 de la Constitución, con la
finalidad de determinar la inconstitucionalidad del numeral 3 del artículo 77 en el
Código Orgánico de la Función Judicial. Throughout the exposition of this paper will be shown an analysis of the rules that
regulate the remotion of the notary as a server of the Judicial Function if this one has
been called to a trial for having been involved in felonies that are typified on the Penal
Code and are punishable with imprisonment or seclusion in accordance with the article
77 numeral 3 and also with the article 122 numeral 1 of the Judicial Function Organic
Code.
In the first part of this investigation will be shown the legal nature of the remotion and
the process that the Judiciary Council follows to remove a notary that has been called
to a trial. On the other hand, the second part will be focused on presenting an analysis
of a protective action that was presented against the General Director of the Judiciary
Council for having carried out the removal of a notary on 2020 violating her right to
the presumption of innocence.
The main objective of this analysis is to demonstrate that there is a normative conflict
between the rules that regulate the remotion that are below the Constitution and the
rule that establish the right to the presumption of innocence as a basic guarantee of the
due process that is on the article 76 numeral 2 of the Constitution; just in order to
determine the unconstitutionality of the numeral 3 from the article 77 of the Judicial
Function Organic Code.
